Hearings & Outcomes

The Arkansas Department of Labor and Licensing provides the Arkansas HVACR Association NewsMagazine with copies of hearings and their results. This information is covered by the Freedom of Information law and is available to the public. The NewsMagazine will include that information in subsequent issues; however, due to time difference between hearings and date of publications, not all hearings will be included. It is the NewsMagazine’s intent to be transparent in providing information to our industry and to support the efforts of our program to administer the law and regulations with fairness and effectiveness to protect the public.

Notice of Hearing on Violations and Proposed Penalties Date: July 17, 2026 Subject of Hearing: Preston Minnie, License # 1060484 Case # KB12052025B Potential Penalty:

Arkansas Law provides that the Board may assess a civil penalty not to exceed $1,000 per violation and each day of a continuing violation may be deemed a separate violation for purposes of penalty assessments. Additionally, the Board may revoke or suspend a license. Precursory Reason for Investigation: Inspector received a complaint from Homeowner, Dover, AR Violations Noted: 1 violation of IMC 2021 603.2 Incorrect size on return 1 violation of IMC 2021 603.4 Duct incorrectly sized 4 violations of IMC 2021 603.9 Airtight not sealed, incorrect tape used 4 violations of IMC 2021 603.18 Volume dampers not installed Subject Comments: He had family health problems and homeowner would not allow him to make repairs. Mr. Minnie was found guilty of all 10 violations and fined $5,000. It has been my experience that person’s cited for violations of law and regulation have been given reasonable opportunity to correct the errors. Failure to make those corrections may result in a citation after which additional time may be allotted for correction. It is always the primary focus of inspectors to help homeowners receive a safe and correctly operating HVAC system. Persons failing to make corrections may be summoned to a formal administrative hearing at which time they may testify and / or be represented by an attorney. The Board gives the person ample time to testify as well as listen to the inspector’s discoveries. Discussion is focused on matters of fact, law, and regulation. The Board then decides to find guilt or innocence and approve or amend the recommend penalty. If a person is assessed a penalty, they are given time to make payment as determined by the Board in the hearing. Editor’s Note:
